Delay in filing review application, which is 58 days, is condoned. This application has been placed before us by circulation in terms of Regulation 15 (2) of the Consumer Protection Regulations, 2005. The review is sought on the basis of averments made in para 4 of the review application and the grounds specified after paragraph 6 of the application. The review is sought, inter alia, on the ground that it is not a case of deficiency on the part of petitioner; that the matter pertains purely to a contract, which was cancelled and the Consumer Forum has no jurisdiction and that the order of the Commission is contrary to the Specific Relief Act. We are afraid that none of these grounds can be considered in a review application as the challenge for review is on the merits of the matter, which has already been decided by order, which is sought to be reviewed. It is now well settled that review in not an appeal in disguise. We do not find any ground for review sought by the petitioner and the review application is hereby dismissed with no order as to cost.
