Today is fixed for showing cause by the complainant and payment of cost of Rs.500=00 to the Consumer Legal Aid Account, Purba Bardhaman, i.d., the case will be dismissed for non-prosecution
No step taken by the complainant today. None appears on behalf of the complainant during its call repeatedly.
On scrutiny of records, it appears from the record that on 11.07.2018 complainant was directed to file evidence. Thereafter five dates elapsed but the complainant only filed adjournment petitions for filing the evidence on the next date.
Thereafter on 01.02.2019, vide Order No.20 again complainant filed petition for filing evidence on the next date and the same was allowed subject to payment of cost of Rs.500=00. Then on 28.02.2019 the complainant neither deposited cost of Rs.500=00 nor filed evidence rather filed a petition praying another date for filing evidence.
Thereafter on 28.03.2019, vide Order No.22 no step taken by the complainant and none appeared on behalf of the complainant. Therefore, the complainant was directed to show cause as to why the complaint shall not be dismissed for default.
Thereafter three dates elapsed but the complainant did not file any show cause. Today also the Complainant is without any step. None appears on behalf of the complainant during its call.
Under such circumstances, this Forum is of the opinion that the complainant has lost interest to proceed with complaint further for which neither took any step nor deposited the cost as imposed upon him for submission of his evidence.
Hence, it is
O r d e r e d
that the present Consumer Complaint being No.72/2018 be and the same is dismissed due to non-prosecution against the Opposite Party without any cost.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
