The Ld. Agents of both sides are present.

The Complainant files a petition praying for withdrawal of the case with a permission to file the case afresh.

The petition is taken up for hearing.

The Ld. Agent for the Complainant submits that the OP has raised an objection regarding filing of the case without authorization from his father Bisweswar Roy, since deceased.  He submits that the Complainant intends to withdraw the case with a permission to file the case afresh.

The Ld. Agent for the OP has raised objection.  It is argued that the prayer for withdrawal of the case with a permission to file the case afresh should not be entertained.

Heard both sides.  Considered.  The prayer of the Complainant is allowed. 

The Complainant is permitted to withdraw the case with a permission to file the case afresh on the same cause of action if not barred by law.

The case is disposed of as withdrawn by the Complainant.
