The complainant is absent without any step. Opposite Party is present through his advocate. The case is fixed for passing necessary order today. From perusal of order sheet and C/R it seems that the case is pending from 07.09.2021 for hearing upon a petition filed by the O.P. vide petition No.82/21, but due to absence of the complainant till 27.06.2022 hearing could not be done. Vide order dtd. 27.06.2022 the complainant was allowed last chance for hearing fixing 29.09.2022 for the same, but the complainant has failed to avail that last opportunity of being heard. Due to long absence of the complainant without step the case is unnecessarily pending.

From perusal of the complaint petition it is found that the complainant himself is an advocate by profession and a resident of Dibrugarh town within the jurisdiction of this Commission and it is not expected on the part of an advocate of not appearing in his own case. In this case the O.P. submitted their W/S on 05.08.2021, almost more than a year ago along with the petition No.82/21.

Considering all above aspects this Commission is of the opinion that the complainant is no more interested in proceeding the case further. Hence, this case is dismissed for default of the complainant.

Case dismissed.
