Complainant represented.

Present complaint has been filed alleging deficiency in service by the OP while they were discharging their duties at Sadar Hospital Jehanabad, in the capacity of Government Surgeon and the compounder. Learned advocate has submitted that for getting registered and treated at the hopital he had paid sum of Rs. 2/- only which according to him was the consideration.

As per the settled procedure for treatment of a patient Rs. 2 is realized as the registration fee of the patient no amount is paid as consideraytion for the treatment or the surgical operation form by the surgeon at the Govt. Hospital. As such neither the hospital nor the doctors or nursing staff etc. are treated as service provider and defined consumer protection Act, 2019.

Hence finding the present complaint without any factual and statutory merit or having any kind of consumer and service provider betweeen the complainant and OP, the present complaint is dismissed.
