Today is fixed for filing W/V and Vokalatnama by Proforma OP No.6 and hearing of the MA being No. 32/2020 dt. 13.02.2020.

Complainant files hazira through Ld. Advocate. OP Nos. 4 & 5 also file hazira through Ld. Advocate. OP Nos. 1,2 & 3 did not take any steps. M.A. being No. 32/2020 is taken up for hearing and order.

Heard the Ld. Advocates of both sides. Perused the case along with petition of M.A. case.

It appears that the complainant has prayed for directing the OP Nos. 5 & 6 to provide the BHT (Bed Head Ticket) of the complainant for the period from 20.08.2016 to 31.08.2016 and 21.01.2017 to 05.02.2017. This matter is related to the collection of evidence but the case is not in the stage of evidence now. W/V has not yet been filed by the Proforma OP No.6 along with Vokalatnama.

From the order dt. 6.3.2018 it appears that the specific order against the OP Nos. 1,2 & 3 has not been served though it was stated that ‘refusal’ tantamount to ‘receive’ the notice. Accordingly, the case do proceed against OP Nos. 1, 2 & 3 .The matter of calling for BHT  from OP Nos. 5 & 6 or providing or production of the same may be done in the stage of evidence.

Accordingly, the petition dt. 13.02.2020 being M.A. 32/2020 is thus disposed of in view of the findings of this matter.

The prayer of OP No.6 is allowed as a last chance.

To 16.06.2022 for filing Vokalatnama  and W/V by OP No.6 positively, i.d., necessary order as per law will be passed.
