OP No. 1, 2 & 3 are represented by Ld. advocate. Complainant files an application praying for necessary order for transfer of this matter to Lok Adalat on the grounds stated in the application.

Heard Ld. advocate of OP no. 1, 2 & 3 they raised strong objection against the prayer of the complainant. Ld. advocate of OP No. 1, 2 & 3 submits that no talk of compromise is going on between the parties and today is fixed for filing show cause.

Having heard Ld. advocate of OP no. 1, 2 & 3 and on perusal of the instant record it appears that today is fixed for filing show cause by the complainant as to why the matter shall not be dismissed for non prosecution. It is now 2.30 PM. Neither the complainant nor the Ld. advocate for the complainant is found present. No show cause is also filed on the side of the complainant.

Accordingly we are of the view that complainant is not at all interested to proceed with this matter furthermore.

Hence, it is,

ORDERED

That the instant consumer case being no. 31/2019 is hereby dismissed for non prosecution.
