Final Order / Judgement

           After hearing the Ld. Advocate on the point of admissibility of the Complaint it appears that the Complaint has not been filed by any person falling under the category of the Complainant as defined under Section 2b of the Act.

           The case relates to medical negligence in carrying out operation upon the person namely Smt. Sikha Dey. The Complainant happens to be the Son of Smt. Sikha Dey. He is not authorized to do so. Section 2b of the Act prescribe that only a Consumer or any voluntary Consumer  association or any Central or State Government or one or more Consumer where there are many and the legal heirs in case of death of the Consumer. Therefore, the case is not maintainable and it stands for dismissal.

            Hence

                        It is ordered

                                              That the Case be and the same is dismissed being not maintainable and without being admitted.
