FINAL ORDER / JUDGEMENT

Both the complainant and O.P. are present by filing hazira.

W.V. is filed by O.P.

O.P. is represented by Misha Singha.

The case is fixed for filing W.V. in default Ex-Parte hearing. At the time of hearing both parties filed a joint petition stating that the matter is amicably settled between them as neither party is fully at fault for the loss and damage of the Super Eco Bike which was purchased by the complainant from the O.P. at the initial price of Rs.43,000/- . Both parties have therefore come to a settlement whereby O.P. will pay to the complainant Rs.13,000/- in all by two installments within October, 2022 and the complainant will hand over all the papers of the Eco Bike to the O.P. after receipt of settled payment and the O.P. will after receipt of the papers retain the ownership and possession of the Eco Bike henceforth.

Both parties have expressed their willingness not to proceed further with the case and prayed for disposal of the case on such settlement.

                                                                                         Hence, it is ordered

 

That the case is disposed on settlement on the terms and condition stated hereinabove. Both parties must comply with the terms and condition of the settlement without fail otherwise the same can be executed in accordance with law.

Let a copy of this order be handed over to both parties at free of cost.
