Present Revision is directed against the Order dated 05-09-2017 of the Ld. District Forum, North 24 Parganas in CC/167/2017.

Case of the Revisionist, in short, is that, on 05-09-2017, it submitted a petition before the Ld. District Forum for deleting its name from the cause title of the complaint.  However, since the Ld. District Forum already passed necessary order to proceed ex parte against this Revisionist by then, the said petition was rejected by the Ld. District Forum.  Accordingly, by filing this Revision, the Revisionist prayed for setting aside the said order.

Heard the Ld. Advocates for the Revisionist and Respondent No. 1 and perused the documents on record.

On due consideration of rival submission of the parties and the documents on record, in the interests of natural justice, we deem it appropriate to allow the prayer of the Revisionist.

Hence,

O R D E R E D

The Revision stands allowed on contest against the Respondent No. 1.  The impugned order is hereby set aside.  Parties to appear before the Ld. District Forum on 21-01-2019 for consideration of the expunge petition of the Revisionist.
