This revision petition under Section 47(1)(b) of the Consumer Protection Act, 2019 is filed by the Moradabad Development Authority through its Secretary against the order dated 23-04-2022 of the learned District Consumer Commission, Sambhal passed in Complaint Case No. 107 of 2018 by which the learned District Consumer Commission has rejected the application 12C2 filed by the revisionist Development Authority beyond the prescribed time.

Sri Abhishek Mishra, learned Counsel for the revisionist appeared.

Heard learned Counsel for the revisionist and perused the record.

It is contended by learned Counsel for the revisionist Development Authority that the complaint itself is not maintainable for the reason that the District Consumer Commission, Sambhal has no jurisdiction to proceed in the matter and further that the complainant has prayed before the District Consumer Commission for payment of his fee and charges which is not covered within the provisions of the Consumer Protection Act.

We are expressing no view with regard to the aforesaid submission which will be properly dealt with by the concerned District Consumer Commission in accordance with law preferably within a period of three months from the date of production of the certified copy of this order.

With the above direction instant revision petition is finally disposed of.

Let copy of this order be made available to the parties as per rules.
