On the last date of hearing, counsel for the petitioner had sought time to go through the latest judgment of Honle Supreme Court in Electricity Case, i.e. U. P. Power Corporation Ltd. and Ors. Vs. Anis Ahmed (Civil Appeal No. 5466 of 2012) decided on 01.07.2013. Today none is present on behalf of the petitioner. Present case pertains to theft of electricity. In view of the decision of Hon’ble Supreme Court in U.P. Power Corporation Ltd. and Ors. (supra), the complaint filed in the present case before the District Forum under the Consumer Protection Act, 1986 is not maintainable. Consequently, present revision petition is also not maintainable and the same is hereby dismissed. However, liberty is granted to the petitioner to seek appropriate remedy available to him before the appropriate Forum.
