Today is fixed for further hearing and necessary order.
Ld. Counsel for the Ops files hazira. No step taken by the complainant. None appears on behalf of the complainant during its call.
Ld. Counsel for the Ops states that the complainant has received her claim amount through cheque.
It is evident from the record that the Ops filed a letter addressed to the ld. Advocate of the OP from Senior Superintendent of Post Offices, Asansol Division, Asansol, 713 101, dated 11.04.2019 that a cheque being No. 171042 dated 23.02.2019 for Rs. 5,73,975=00 has been issued in favour of the complainant – Smt. Monju Haldar.
It is also evident from the order vide No. 36, dated 11.01.2019 that the complainant filed a petition stating that there is a chance of compromise between the parties.
It is also evident from the record that the complainant has not taken any step on 17.04.2019 & 21.06.2019. Today also the complainant is absent and without any step.
Under such circumstances, we are of the opinion that the matter has been amicably settled between the parties out of this Forum. Therefore, the complainant is not taking any step to drag the matter further.
Hence, it is
O r d e r e d
that the Consumer Complaint being No. 223/2015 be and the same is dismissed for default. There is no order as to costs.
Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
