Heard Learned Lawyer for the petitioner.
Learned lawyer for the petitioner submits that
the matter has been compromised between the
parties and a petition dated 14-09-2018 along
with affidavit of the above effect has already
been filed by the complainant which is on the
record. He further submits that the case may be
disposed off.
Perused the record. On persusal of the
record it transpires that a petition dated 14-09-
2018 along with affidavit has been filed on
behalf of complainant to dispose of the case in
terms of compromised It has been also
mentioned in the petition that the complaint do
not want to proceed with the case because
insurance company is ready to pay the amount
of claim.
Complainant is also present before the
court and supports the factum of petition. Since,
the matter has been compromised between the
parties and the complainant does not want to
proceed with the case, so it is in the interest of
justice that the case be disposed of after
recalling date fixed. Accordingly, next date
31-10-2018 is recalled and the case is dismissed
as the withdrawn.
