Complainant in person is present and submits his case.

Upon considering his submissions and on careful scrutiny of the entire materials on record, we find that the cause of action took place on 17.5.08 between one Pragati Roy and Manorajnan Roy with the o.p. But in the instant case we find that the case has been filed by Manorajnan Roy only and Pragati Roy has not filed any complaint even if the purchase agreement has been signed by both of them. Beside this, the cause of action took place on 17.5.08 and complainant filed this complaint before this Forum on 20.12.14. Under such circumstances, this Forum is not in a position to entertain the petition due to the fact that the matter has been barred by limitation since it has been filed long after two years from the date of cause of action. Besides, complainant has not filed any petition towards condonation of delay and the entire petition is defective since the petition filed by Manorajnan Roy whereas the purchase agreement has been signed by Pragati Roy and Manorajnan Roy. Under such circumstances, this Forum observes that the instant complaint is rejected due to the reasons as stated hereinabove.
