This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. As the opposite party not appeared before this Commission even after accepting the notice, on 23/12/2020 this Commission declared the opposite party as ex parte. Since then this complaint is adjourned for the purpose of filing of the affidavit of the complainant. As the complainant was continuously absent, this Commission has issued a notice to the complainant on 23/04/2022 to appear before this Commission today to further proceed with this complaint. When the case came up for consideration today, it is noticed that the notice issued to the complainant was returned with endorsement ‘addressee left’. The notice was issued to the complainant by this Commission in the address mentioned by the complainant in the complaint. In view of the continuous absence of the complainant and the non filing of the affidavit, we find that the complainant is not interested to further proceed with this complaint.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
