The case of the complainant (power of attorney holder, wife of the complainant) presented on 17/11/2014 is as follows.
He had purchased (manufactured by Epson M.X. 14) on 21/11/2012 for an amount of Rs.7,238/- from opposite party 1. The printer became defective on 23/07/2013. The 2nd opposite party service centre inspected the printer and told that, it will rectify within a short time. Thereafter, the complainant contacted the opposite parties several times for rectifying the defects. After one year, the opposite party informed that the spare parts is not available. There was a clear deficiency in service on the part of the opposite parties. Hence this complaint.
The notices were served with the opposite parties. They did not appear either in person or through their counsel even after accepting the notice from this Forum.
The complainant filed proof affidavits and documents, which are marked as Ext.A1 to A3.
Heard complainant. We have gone through the complaint, documents and evidence. The case of the complainant stands un-challenged by the opposite parties even after accepting the notice from this Forum. So we have no reasons to dis-believe the case of the complainant. We are of the opinion that the case of the complainant is be allowed.
In the result, the complaint is allowed as follows.
- We direct the 1st opposite party to refund Rs.7238/- being the price of the printer and pay Rs.1,000/- as compensation for inconvenience and pay Rs.1,000/- as costs of these proceedings to the complainant.
The Order shall be complied with within a period of 30 days of receipt of copy of this Order. If not complied as directed, the award amount will carry @ 10% interest per annum from the date of Order till payment.
