The case of the complainant is that,

The complainant is the widow of Late Sukumaran, Kuzhikandathil, Panikkankudy Village, Udumbanchola Taluk. They have no children their wedlock. The complainant is the absolute owner of 63.5 cents Patta Land which is inherited by her husband. The Patta was pledged by the father of Sukumaran to opposite party. The property which is inherited to her husband from his father. Now the complainant is the absolute owner in possession of the said property. It is declared as per the Judgment in OS No.96/16 of Munsiff Court, Idukki. The Judgment is produced here along with the complaint. The complainant

approached the opposite party for getting original patta from them. But the opposite party is not ready to release the document. Hence the complainant is approaching before the Forum against the acts of opposite party. It is deficiency in service on the part of the opposite party.

 

The Forum served the notice to opposite party. Opposite party appeared before the Forum and submitted that they are ready to give the original Patta to the complainant. But they have needed court order for releasing the original Patta.

 

Hence the Forum considered the complaint and documents. As per the Judgment of Munsiff Court, Idukki in OS 96/16, the complainant is the absolute owner of the above said property.

 

Hence the petition allowed. The Forum directs the opposite party to deliver the original patta of the said property to the complainant within 15 days from the date of receipt of a copy of this order.
