Present  : Sh.R.P.Singh, Adv.counsel for the applicant

                Sh.Jatin Sharma son of Satish Sharma, Branch Manager of the respondent Cholamandalam Investment and Financé Co.Ltd.alongwith Sh.Sandeep Kapoor, Adv. and suffered statement that due to inadvertence and without any malafide intention to disobey the order of interim stay passed by this Hon’ble Commission repossessed the vehicle in question       and after receiving notice of the present Misc.application, he came to know about the aforesaid stay order passed this Commission and tendered unconditional apology before this Commission. Further more, Sh.Jatin Sharma, also stated in his statement that they are ready to releases the vehicle forthwith and prayed for taking lenient view against the respondent company. It is further averted that all this happened due to inadvertence and not intentionally. Counsel for  the applicant has stated at bar that since the respondent has tendered unconditional apology before this Commission, they be directed to release the truck in question forthwith. Counsel for the applicant has also suffered statement that there are perishable goods lying in the truck and he reserved his right to take appropriate action qua the damage of the goods due to the act of repossession by the respondent. In view the above statements, respondent is directed to immediately release the truck today itself. In view of the above, the present application stand disposed of. File be consigned to the record room.
