Heard. Vide impugned order dated 23.9.2013, the appeal of the petitioner was dismissed in default due to non-appearance before the State Commission, which reads as under ; 3.9.2013 Present : Appeal was received by post. Notice was sent to the appellant for today. Despite service, appellant has not put in appearance. Hence, the appeal is dismissed in default of appearance of the appellant. For the reasons mentioned in the present revision petition, we allow the same and set aside the impugned order and restore the appeal of the petitioner before the State Commission, subject to payment of cost of Rs.5,000/- to be deposited in the onsumer Legal Aid Accountof this Commission, within four weeks. Accordingly, we remand the matter back to the State Commission, with specific directions that it should consider the matter afresh, in accordance with law after hearing. Present revision stands disposed of accordingly. Petitioner is directed to appear before the State Commission on 26.5.2014. Dasti in addition.
