Adv.Mr.Borkar is present for the appellant. He submitted that permission may be granted to the appellant to withdraw the appeal with a liberty to file fresh complaint before the appropriate Forum. Adv.Mr.Sachin Jaiswal is present for the Resp. and he submitted that he has no objection for filing fresh complaint before appropriate Forum, but he requested that already there was enormous delay in filing the appeal and that the time consumed during the period of appeal may not be saved for the purpose of limitation, if any such complaint is filed. Hence the permission, as sought, is granted. This appeal is disposed of as withdrawn with a liberty to the appellant to file fresh complaint before the appropriate Forum in accordance with law.

The appellant shall pay cost of Rs.1000/- to the respondents which is a condition precedent for filing the fresh complaint before the appropriate Forum.
