         Heard Mr. Pankul Nagpal, counsel for the revision petitioner on admission for some time. From a perusal of this impugned order, it is seen that the State Commission has passed the impugned order for non-compliance of its direction of 22.03.2013 to deposit a sum of Rs. 20,000/- towards travel and other allied expenses. Simultaneously, the impugned order also indicates that the option of producing and examining the witness is still open to the opposite party i.e. the present petitioner. Learned counsel argues that it is an independent witness and may not respond to the request of the revision petitioner to tender evidence before the State Commission. This argument can find no legs to stand on as the State Commission did offer them an opportunity, which was lost due to non-compliance of the order.    At this stage, learned counsel seeks to withdraw the revision petition with a prayer that the option to make a fresh application before the State Commission in this behalf should be open to him.

          In view of the above, the revision petition is dismissed, as withdrawn. The State Commission may consider a fresh application in this behalf, if considered just and equitable and necessary for determination of the case.
