The Misc. Application filed by the opposite party no.3/Branch Manager, Canara  Bank dated 30/12/2019 registered as Misc Application on 12/07/2023 is taken up for hearing.

Heard Ld. Advocate for the opposite party no.3 as well as Ld. Advocate for the complainant.

Ld. Advocate for the opposite party no.3 submits that this application has been filed by the opposite party no.3 long back in the year 2019 but inadvertently it was filed in the complaint case no. CC/286/2019. Subsequently, on detection it has been registered as Misc. Application being no. MA/199/2023.

Ld. Advocate for the opposite party no.3 prays for expunge the name of the opposite party nos.1 and 2 on the grounds that both opposite party nos.1 and 2 are not any way connected with the working of the branch banks of Canara Bank.

Ld. Advocate for the complainant raised objection against the prayer of opposite party no.3.

On perusal of the record of CC/286/2019 it appears that after service of notice opposite party nos.1 to 3 however filed written statement jointly and took the same plea therein. Thereafter the case proceeded and ultimately the case was fixed for BNA and argument on 12/07/2023.

Thereafter the complainant by filing MA/189/2023 has prayed for filing supplementary evidence on recall which was allowed by the instant Commission. Today is fixed for filing evidence of the complainant on recall. As it appears from the record that the complaint case is at advance stage, the prayer of opposite party no.3 stands rejected in limini on contest without cost.
