MR LAXMI NARAYAN PADHI, PRESIDENT…                     The brief story of the complaint is that, the complainant has a mobile shop by name & style Digital Studio Life at Jeypore. Under a scheme, the OP floated DNA antivirus products and complainant procured huge number of DNA antivirus for mobiles, by paying Rs.50,044/- for 97 pieces on dt.29.5.14, 62 pieces on dt.12.6.14 for Rs.30,000/- and 110 pieces on dt.30.6.14 for Rs.50,060/-, on such conditions of contract as made with the OP. The OP under the scheme has tie ups with the oriental insurance Co & Tata AIG antivirus products to customers, but found that, there is no insurance and no antivirus benefits in the products. The customer purchasing the product demanded the return of the price of the product, and the OP.s does not respond to the complaint. Hence, duped of a large amount of money on purchasing of the product, which was procured him through hand loans from friends and relatives, hence for such delivery of service he claimed a compensation of Rs.1,00,000/- inter alia other reliefs.

2.         The complainant as filed nothing in support of his contention.

3.         Notice served upon OP along with copy of complaint. But the notice could not be served and returned, with note of posts “addressee left”  "addressee unknown" etc.

4.         The complainant also failed to file any memo, depicting the correct address of OP, non represented for issuance of any proclamation to enforce the presence of OP. Hence for want of proper address of OP, the complaint is dismissed on default.

5.         As thus the complaint petition is disposed off. Free copies of this extract be supplied to the parties on demand. No cost. Pronounced in the open forum on this the 18th April' 2016.
