                Statement of Sh.R.P.Singh Adv.counsel for the J.D. recorded to the effect that amount of Rs. 22926/-  vide cheque bearing No. 134499 dated 13.10.2023 has been paid to the decree holder and nothing is due towards the J.D. qua the present execution application. On the other hand, counsel for the decree holder suffered statement that decree holder has accept the cheque from the J.D. and is ready to withdraw the present execution application. Similarly, there is Misc.application bearing No.148 of 2023 is pending in this Commission in which a cheque of Rs. 21034.50 P was received from the Hon;ble State Commission. As per the statement suffered by the J.D. in execution application that remaining amount which is payable to the decree holder has been received from the Hon’ble State Commission and the statement suffered by the counsel for the J.D. in execution application No.77 of 2022 construed that opposite party has no objection if the amount of Rs.21034.50  lying with this Commission be disbursed to the complainant. Besides this, counsel for the opposite party also stated at bar that they do agree with the fact that amount of Rs.21034.50 P may be released to the complainant also. In the totality of these circumstances by disbursement of amount of Rs.21034/-, will construed that  full and final compliance of the order passed by this Commission has been made. In view of the facts as detailed above, amount of Rs.21034.50 P be released to the complainant against proper receipt and identification. Copy of the statement so recorded in execution application No.77 of 2022 be also placed in MA No.148 of 2023.Similarly, the copy of this order be also placed in MA No.148 of 2023. In terms of above, both execution application No.77 of 2022 and Misc.application No.148 of 2023 stand disposed off. File be consigned to the record room.
