MR. PRAVAT KUMAR PADHI, PRESIDENT:-
The Complainant has filed the present C.C.Case without any signature in the petition and also remaining absent continuously. We perused all the documents available on record, wherein Opp.Party has filed it’s written version and stated that, United Bank of India has been merged with Punjab National Bank for which Punjab National Bank may be substituted in place of United Bank of India.
Since United Bank of India has been merged and it is a policy decision Punjab National Bank may be made as Op. Party, and accordingly cause title may be changed.
The Op has filed written version wherein it is stated that the Complainant has availed loan of Rs. 9,98,000/- vide loan A/C No. 0581306719580 and credited only Rs. 25,000/- and adjusted the part of the amount from Term Deposit and waived/exempted and rest amount of Rs. 43,761.84, which is shown in the Credit Information Bureau (India) Limited (CIBIL) but the same (CBIL) has not been impleaded as Opp.Party in the C.C.Case.
Since the Complainant has not signed the complaint petition and not filed any Affidavit, Credit Information Bureau (India) Limited (CIBIL) has not been made Opp.Party, we therefore dismiss the present C.C.Case due to want of signature in the Petition and non filing of affidavit & non-joinder of party.
Issue extract of the order to the concerned parties.
