Today is fixed for hearing.

Direction has been given vide order dtd. 08.08.2022 for put up the CR vide No. CC /133/2018.

Accordingly, case record vide no. cc/ 133/2018 is put up today.

Ld. Adv. for the complainant is present by filing hajira.

He submits that he had filed one case on 20.07.2018 before the office of this commission on behalf of Sri Biswajit Modak and said case was registered on 16.08.2018 and registration of the case was done on 16.08.2018 and registration no. was allotted vide no. CC/133/2018.

Copy of complaint annexure documents were kept in the file of the said case record.

He further submits that one order sheet was prepared in advertently on 01.08.2018 mentioning the name of aforesaid Biswajit Modak and opposite parties described in the petition of complaint and case no. was allotted as CC/124/2018 but neither the copy of complainant or other documents lying in the said record because those documents are lying in CC/133/2018.

I have carefully gone through CC/124/2018 and CC/133/2018 .

I find that complainant Biswajit Modak filed the case on 20.07.2018 and one order sheet was prepared relating to filing of case on 01.08.2018.

Subsequently another filing order was printed mentioning the case no. CC/133/2018.

Petition of compliant and other document are lying in the case record vide no. CC/133/18 and no document lying in the case record vide CC/124/2018.

So, it is clear before us that two filing order sheet were prepared inadvertently relating to the same case record where complainant is Biswajit Modak and OPs are Branch Manager New India Assuracne Company Limited and two others.

Considering the entire matters we think that the case record vide no. CC/124/2018 should be closed.

Hence, the case no. Vide No. CC/124/2018 is disposed of .
