Complainant is absent. Non present on her behalf  to take part in hearing  on admission matter.

Perused the record.  The brief, facts of the case is that  the husband of complainant  Late  Md. Meraj had purchased an insurance policy from o.p of Rs. 2,63,000/-. The further case is that on 06-09-2012 insured was murdered for which Motipur P.S. Case No.- 192/2012 was registered. The further case is that the complainant  filed death claim in the office on 18-03-2015 and the claim No. is - CC-15055008. The further case is that the o.p repudiated the claim of the complainant.

 On perusal of repudiation letter it transpires that the claim of the complainant was  repudiated on 20-04-2015. So, last cause of action arose  on 20-04-2015 As per section 24A of the Consumer Protection Act the complaint should be filed within 2 years from the date on which the cause of action has arisen.

No petition has been filed on behalf of complainant to condone the  delay. The complaint is barred by law of  limitation, so it can’t  proceed.

In the circumstances the complaint petition is dismissed on admission stage.
