Final Order / Judgement

Order no. 2     dt. 30/03/2017

Heard the Ld. Lawyer for the complainant and perused the materials on record. Ld. Lawyer for the complainant submitted that the complainant had 2 savings account being no. 32810035913 and 32610014157 and also a locker account being no. A-69. Complainant wrote a letter dt. 24/07/2014 to the o.p. bank for closing those accounts. Thereafter o.p. bank issued a letter to the complainant informing her that they were unable to recover the annual rent of Rs. 2,734.16/- from her account due to insufficient balance. Complainant had not annexed any document that she had paid Rs. 2,734.16/-  which was due to the bank. Thereafter o.p. bank issued a letter demanding Rs. 8,459.20/- as overdue charge for the charges of safe deposit locker. Ld. Lawyer for the complainant also submitted that the key of the locker is in the custody of the complainant. So it is clear that the locker is still in the name of the complainant. Therefore, we find no deficiency in service on the part of the o.p. bank and therefore the case is rejected.

Since the case is filed by the complainant who is a widow of the ex-employee of the o.p. bank and in order to redress her grievance she could have placed her grievance before Secretary, District Legal Services Authority having the jurisdiction to entertain the said application. Accordingly, the complainant is directed to take steps before appropriate Forum for the selfsame cause of action.

Certified copy be supplied to the parties free of cost.
