Both parties are present.

IA/33/2018 is taken up for the hearing.

Heard both sides. Considered.

Perused the Application for condonation of delay along with its objection filed on behalf of the respondent 1 and 3.

None appears from the side of respondent 2.

It appears that there has been a delay of 35 days in filing the appeal.

Seen the medical certificate from the side of the appellant.

It appears that the appellant was under medical treatment from 10.09.2018 to 10.10.2018 for various ailments and was advised to take rest.

It also appears that Puja Vacation started after 12.10.2018 and continued till 25.10.2018.

There was a single working day i.e. 26.10.2018.

Dates 27.10.2018 and 28.10.2018 were Saturday and Sunday respectively.

I find nothing seriously derogatory for filing the appeal not within time.

The ground for delay in filing the appeal appears to be sufficient and acceptable.  

The delay as such is condoned subject to payment of cost of Rs. 1,000/- to the SCWF, W.B.

                                            The instant IA is thus disposed of.

Fix 17.01.2019 for hearing of the appeal.
