Complainant representing through its Founder Trustee – cum – Chairman, KIMET Trust Sri Bansidhar Pradhan  files a memo which reads as follows:-

“The present complainant/petitioner beg to pray before this Hon’ble State Consumer Commission to withdraw the present C.C.Case No.38/2019 on the ground of maintainability with a prayer for grant of liberty to file this matter before the appropriate forum for early redressal of the grievance of the complainant in order to revive the institution for the larger interest of the students.”

It is submitted by Sri Pradhan that in view of principle laid down by the Hon’ble Supreme Court in the  case of Pratibha Pratisthan and others vrs. Manager, Canara Bank and others (2017) 3 Supreme Court Cases 712, the complainant may be permitted to withdraw the complaint with liberty granted to approach appropriate Forum.

In view of the above, complaint is disposed of as withdrawn. Complainant Trust is at liberty to approach appropriate Forum for redressal of his grievance.
