Smt. Jigeesha Mishra, President : - This is the case of complainant alleging deficiency in service  against the O.Ps.

The case of the complainant is that the complainant has availed finance of Rs.18,26,680/-( Rupees eighteen lakhs twenty six thousand six hundred eighty only) from the O.P vide contract/agreement No. 0SS008278 dt.25.10.2016 for the vehicle TATA LPK 2518 bearing Regn. No. OD 23B-5022 to maintain his livelihood.  The complainant has already paid Rs.1,70,000/- (Rupees one lakh seventy thousand only).  The complainant has to prayed the entire loan taken by him till 21.08.2019.  The complainant used to pay monthly installments to the collection agent of the O.P but some of the installments paid to the O.P are not reflected in the account statement furnished by him.  The receipt of the payment are also not furnished by the O.P. hence the complainant requested the O.P to furnish the account statement along with copy of agreement so as to calculate the exact due against him.  After repeated request the O.P had not supplied the account statement and copy of the agreement.  Hence the complainant filed the case before this Commission and prayed for supply of account statement along with copy of agreement.                                     

 

 2. The case of the O.P is that the O.P the Branch manager, Indusind Bank Ltd., Sambalpur filed the status of the loan and prayed for dismissal of the complaint. The O.P submitted that the loan was closed from dated 31.03.2019 and stated that there is no need of supply of account statement of the loan.

3. Perused the documents and it reveals that the loan was closed from dated 31.03.2019. Hence there is no need of relevant documents and supply of account statement of financial vehicle. Accordingly the case is disposed of.

Order pronounced in the open court today the 26^th day of October’ 2022 under my hand and seal of this Commission.
