File taken up today before the Lok Adalat.
2. Again none has come up on behalf of complainant. He is not even represented by his authorized counsel. Perusal of the record reveals that way back on 25th November, 2021 written request was put forth by none other but the complainant himself intending to withdraw the present complaint. His application was also supported by his sworn affidavit.
3. However, since the complainant himself was not coming forward and he was also not represented by his counsel, so this Commission in its own wisdom issued separate notice to him. Even after resorting to this exercise, this purpose could not be solved and complainant has not come forward. During this proposes, lastly again registered notice was issued to the complainant and the said registered notice has also not been received back and insisted thereof, we have before us track consignment, which clearly indicates that the item has duly been delivered and the same has been confirmed. Even otherwise also, learned counsel for the opposite party has also categorically apprised us that the matter has already been settled which also supports the affidavit already put forth by the complainant to withdraw this complaint.
4. Therefore, in such a scenario, when the complainant is not coming forward to pursue his complaint, we are of the view that he does not wish to continue with the present complaint and as such, dismiss the present complaint.
5. A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be uploaded forthwith on the website of the Commission for the perusal of the parties.
6. File be consigned to record room alongwith a copy of this order.
