Today is fixed for filing requisites. No step is taken by the Complainant. The record shows that no step was taken by the Complainant on 18.08.21, 22.12.21, 28.04.22, 25.07.22, 11.11.22, 21.02.23, 30.05.23, 03.08.23, 30.10.23 and today i.e. 05.02.24. The case of the Complainant as per materials on record is that the Complainant alleged that the Complainant is an agriculturist and he used to earn money by cultivating land. The OP No.1 had a system to distribute water for irrigation among the cultivators through ‘’Deep-Tubewell System’’ for Boro Paddy cultivation. The interested cultivators of Mouza Kanfala used to cultivate Boro Paddy by paying requisites subscription to the OP No.1. The Complainant is also a cultivator of the said mouza, he paid Rs. 884/- on 23.02.20 for cultivating(Boro Paddy) at mouza Kanfala, Plot No. 1848, Area 66 Dec. The Complainant also took Krishi Loan from Bangio Gramin Vikash Bank, Nabagram Branch for the purpose of cultivating the said Boro Paddy. The Complainant prepared the above land for Boro Paddy cultivation, but the OP No.2 did not supply the water in due time, rather he threatened the Complainant with dire consequences for that reason, the cultivation of the said land in the Boro season measurably failed. The Complainant intimated the matter to OP No.1. But the OPs denied to provide with such water supply. The Complainant intimate the matter to OP No.1 on 19.03.20, but he did not pay any heed to that effect. He prays for passing an order directing the OP Nos. 1 and 2 to compensation of Rs. 50,000/- for intentionally causing loss to the Complainant. We peruse the materials on record. Moreover, considering the facts and circumstances of the case we are of the view that the instant case has no merit. Further more, it appears to us that the Complainant is not at all interested in the instant case as the Complainant took no steps from 18.08.21 to till now. In view of the matters discussed above we are of the view that the instant case is liable to be dismissed on merit. Hence, it is Ordered that the complaint Case No. CC/67/20 be and the same is dismissed on merit against the OPs. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
