This is an application under Order 22 Rule 2 (1) of C.P.C filed on behalf of the respondent for substitution of legal heirs of the deceased respondent.
Heard Ms. B.Rajbonshi, learned counsel, appearing for the respondent. However, none appeared for the revision petitioner.
Ms. Rajbongshi has submitted that the respondent has expired on 1st May,2018 leaving behind his wife and two minor sons , namely,
1. Smt. Gayamoni Chaotal, Wife
2. Shri Biru Chaotal, Son
3. Shri Raju Chaotal, son
In view of the above, Ms. Rajbonshi has prayed that the names of legal heirs mentioned above, be allowed to be substituted.
In view of the above submission so made, prayer for substitution is allowed.
Registry is directed to correct the cause title accordingly.
Misc case is allowed and disposed off.
