Today is fixed for hearing of this M.A. case, W/O, if any, in the meantime. Both sides are found present. This matter is contested by the O.p.

Heard both sides. Considered submission.

Perused the petition which is filed under Section 38(8) of Consumer Protection Act, 2019 for staying the entire proceeding of complaint case No.131/2021.

This District Commission is of the view that as per provision of Section 38(8) of the Consumer Protection Act, 2019, there is no scope for staying any proceedings or the complaint case. There is specific provision for submitting prayer in the matter of staying the operation of the complaint case. But that process has not been followed by the applicant/O.p. no.2.

So, prayer for staying the operation of C.C. case No.131/2021 is hereby rejected.

In the light of the observation made above this M.A. case is disposed of. No order is passed as to cost.
