While disposing of the Revision Petition on 17.11.2008, we had directed the respondent to refund the amount deposited by the petitioner along with interest at the rate of 5% per annum from the respective dates of payments of various amounts till its realization and, if the amount is not paid within 4 weeks, then the respondent was required to pay interest at the rate of 9% per annum.

Admittedly, the respondent did not make the payment within 4 weeks. Deposited amounts were paid with interest at the rate of 5% per annum. Present application has been filed seeking compliance of our order dated 17.11.2008 and a direction to the respondent to pay the balance amount with interest at the rate of 5% per annum. Counsel for the respondent states that the balance amount shall be paid to the petitioner within 6 weeks from today.

Misc. Application stands disposed of accordingly. A copy of this order be given dasti to the parties.
