Aforesaid Complainant filed this case against the aforesaid O.P praying for direction to refund Rs. 4,53,912.30, interest over the aforesaid amount, compensation amounting to Rs. 1,50,000/-, litigation cost amounting to Rs. 35,000/- and other reliefs i.e. total claim amount is Rs. 9,38,912.30.

Complainant Dr. Jibankush Biswas is present. Ld. Advocate for the Complainant is present.  

Ld. Advocate for the O.P is present.

Case is placed before this UPOBHOKTA LOK ADALAT.

Case is taken up for discussion.

After thorough discussion it is settled that O.P shall refund the aforesaid amount of Rs. 4,53,912.30 along with interest @ 8% p.a. from the date of first payment i.e. on 03-04-2011 to till the date of actual payment positively within 60 (sixty) days from this day. It is also settled that Complainant will relinquish the claim of compensation and cost of the case.

Hence it is,

ORDERED

That the dispute is settled with the condition that O.P shall pay the amount of amount of Rs. 4,53,912.30 along with interest @ 8% p.a. from the date of first payment i.e. on 03-04-2011 to till the date of actual payment positively within 60 (sixty) days from this day.

Complainant relinquished the claim of compensation and cost amounting to Rs. 1,85,000/. Case is settled with the above terms and conditions.

Returned the case record to the Commission.
