ORDER

1.        The present miscellaneous application has been filed by applicant/accused No.1-Sh.Baldev Chand Bansal for recalling the order dated 11.10.2018 wherein the directions were issued to District Collector, Mohali to attach the project i.e. Chinar Homes, Kishanpura, Zirakpur and further for issuing the directions to District Collector, Mohali, to deattach the project i.e. Chinar Homes, Kishanpura, Zirakpur qua the present execution application. Sh.Abhilash Bhatacharya, Vice Counsel for Sh.Amarbir Dhaliwal, Counsel for Complainant is present through video conferencing and has stated that complainant has no objection to the same as prayed for by the applicant/accused No.1 in the present application.

2.        Contents of the miscellaneous application perused alongwith orders dated 11.10.2018 and 16.04.2019, attached with the application, passed by this Commission (erstwhile Forum) in Execution Application No.56 of 2018. Since the parties have compromised the matter and the order dated 11.12.2017 already stood complied with and complainant has already withdrawn the criminal complaint, hence, we recall the order dated 11.10.2018 and the warrant of attachment issued under Section 83 Cr.P.C. 1973 to the District Collector, Mohali vide order dated 11.10.2018 is hereby cancelled and it be called back unexecuted with the direction to the District Collector, Mohali to de-attach the project in question, if attached, in the present execution application. The present miscellaneous application stands disposed of accordingly.

3.        Certified copies of this order be sent to the parties free of cost. The file be consigned.
