In terms of order dated 28.02.2023, complainant has not placed on record legible copy of documents Ex.C3 to Ex.C6. Counsel for the complainant submitted, complainant had not retained the hard copy of the same and copies Ex.C3 to Ex.C6 have been taken from the mobile.
The documents Ex.C3 to Ex.C6 are appears to be material documents as per the pleading of the complainant, but if the same are not legible, these cannot read into evidence and this is a patent defect in the complaint of the complainant. Consequently, it is not a fit case to issue notice of the complaint to the opponent, when the complaint in itself is suffering from patent defect. Hence, without commenting anything further, this complaint is rejected. However, complainant will be at liberty to file afresh complaint against the opponent after removing the patent defect as referred hereinbefore and in fresh complaint, complainant shall disclose the particulars of the present complaint and its fate. File be consigned to the record.
