                 By way of this appeal prayer is made for recalling of the order dated 16.01.2018 passed by the Consumer Disputes Redressal Forum (X), New Delhi in CC No.432/2014 by which the complaint filed by the appellant/complainant has been dismissed for non-appearance.

                 Initially the appeal was opposed by the respondents/OPs. However, after some arguments, counsel for the respondents/OPs has stated that they have no objection if the impugned order be set aside.

                 In view of the reasoning given which are supported with the affidavit of complainant as well as consent given by respondents/OPs, I accept the present appeal, set aside the impugned order and restore the complaint to its original position. Appellant/complainant is warned to be cautious in future.

                 Parties to appear before District Forum on 03.10.2018.  Thereafter, the District Forum shall proceed in the matter in accordance with law.

                 A copy of this order as per the statutory requirement be forwarded to the parties free of charge and also to the concerned District Forum. 

                 File be consigned to Record Room.
