                  Heard Mr. J.K. Bhuyan , learned counsel, appearing for the complainant. Also heard Mr. R.P.Duta, learned counsel, appearing for the opposite party. 

                 Mr. Bhuyan has prayed that he be allowed to withdraw the instant Complaint case with liberty to file afresh before the appropriate forum.

                 Prayer is allowed.

               Complaint is dismissed on withdrawal with liberty to file afresh before the appropriate forum.

                Accordingly the application filed by the opposite party raising maintainability of the complaint stands disposed off.
