This a complaint filed under section 35 of the Consumer Protection Act,2019 alleging deficiency of service on the part of the opposite party.
- Notice issued from this Commission on 04/07/2022 was received by the opposite party. Vakkalath was filed on 29/07/2022. But the version was not file within the prescribed time. It was filed only on 01/10/2022 with IA No. 255/2022 was dismissed as per order dated 03/11/2023 and the opposite party was set exparte.
- Today the case is posted for the affidavit of the complainant as last chance. But the complainant remained absent and there is no representation for him. The onus is on the complainant to prove the allegation of deficiency of service. But the complainant failed to let in any evidence to prove the case so as to get an order as prayed for. The complainant is continuously absent and it appears that he is not interested in pursuing the matter. The allegations are not proved.
In the result, the complaint is dismissed. No order as to costs.
