This appeal has been preferred against judgment dated 12.03.2014 passed by the learned DCF Sawaimadhopur. The learned DCF had allowed the complaint ordering the respondents

JVVNL to pay a sum of Rs.1100/- as cost of the complaint.
In this case the complainant had alleged that Rs.1124/- deposited by him towards consumption of electricity for the month of March 2012 and May 2012 were not accounted for in his account and similarly an amount of Rs.1133/- was consumption for the month of July 2012 was also not accounted for in his account. This fact was not controverted by the respondents before the learned DCF. They accepted the fact that due to error of the computer, the amount deposited by the complainant was not accounted for in his account. However, the learned DCF had accepted that a rectification has been made.
The learned counsel for the appellant has argued that though the respondents have admitted their mistake but still in the forthcoming bills balance amount is being shown as arrears and the learned DCF has not given any direction to cancel this amount shown as arrear.
We have heard the learned counsel for the parties and have perused the record. In the bill an arrear of Rs. 3717/- is being shown against the complainant when the respondents have admitted their mistake that this amount should be accepted.

We accept this appeal and modify the order of the learned DCF to the extent that an arrear of Rs. 3717/- raised against the complainant shall be dropped and he shall be issued bills for current usage of the electricity. Rest of the order is maintained.
