Learned counsel for the appellant submits, on instructions, that he may be permitted to withdraw the appeal execution with the liberty to adopt other legal measures as per law.

In the wake of the submissions made the appeal execution stands dismissed as withdrawn.  The appellant shall have the liberty to adopt any legal course as it may be advised in accordance with law and which may be permissible under law.

Let the certified copies, if any, filed along with the execution application may be returned to the appellant, if so required, as per rules.

          The Registry is requested to send a copy each of this Order to both the parties and to the learned counsel for the appellant.
