ORDER

 

 

 

  1. The present revision has been filed by the opposite party for challenging the order dated 21.04.2022 passed by the District Consumer Disputes Redressal Commission, Gurugram vide which the application filed by the opposite party for dismissal of the complaint on account of lack of pecuniary jurisdiction was dismissed.
  2. Counsel appearing for the complainant has apprised the State Commission that the complainant has already withdrawn the complaint with permission to file a fresh complaint before the Haryana Real Estate Regulatory Authority.
  3. Counsel appearing for the opposite party has confirmed the factum of the complaint having been withdrawn by the complainant with liberty to file a fresh complaint before the Haryana Real Estate Regulatory Authority. Accordingly, the present revision has been rendered infructuous. 
  4. In view of the above, the present revision is hereby disposed of as having been rendered infructuous. However, the complainant would be at liberty to file a fresh complaint before the appropriate Court/Authority.
  5. Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
  6. A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act. The order be uploaded forthwith on the website of the Commission for the perusal of the parties.
  7. File be consigned to record room along with a copy of this Order.
