JUDGMENT

This is an appeal filed before State Commission under Section-15 of the Consumer Protection Act 1986 against judgment and order dated 14-09-2016 passed by District Consumer Forum, Gorakhpur in Complaint Case No. 277 of 2014 Aashish Kumar Srivastava V/s M/s. Spencers Retail Limited whereby the District Consumer Forum has allowed complaint and passed following order.
परिवादी का परिवाद विरुद्ध विपक्षी आंशिक रूप से स्वीकार किया जाता है। विपक्षी को निर्देशित किया जाता है कि वह परिवादी को 1.00 रू0 (एक रूपया) की धनराशि मय 09 प्रतिशत साधारण वार्षिक ब्याज

दि0 11.05.14 से अंतिम भुगतान तक अदा करे। इसके अतिरिक्त परिवादी, विपक्षी से शारीरिक एवं मानसिक कष्ट के लिए 2000.00 रू0 (दो हजार रू0) एवं वाद व्यय के लिए 2000.00 रू0 (दो हजार रू0) भी प्राप्त करने का अधिकारी है। इसके अतिरिक्त विपक्षी 100000.00 रू0 (एक लाख रू0) जुर्माना भी उपभोक्ता विधिक सहायता लेखा निधि में जमा करे। विपक्षी को निर्देशित किया जाता है कि वह आदेश का परिपालन निर्णय व आदेश के दिनांक से एक माह की अवधि के अंतर्गत करे, अन्यथा विपक्षी के विरुद्ध विधि अनुसार कार्यवाही की जाएगी एवं विपक्षी इस प्रकार की पुनरावृत्ति भविष्य में न करे।
Feeling aggrieved with the judgment and order passed by District Consumer Forum, opposite party of complaint M/s. Spencers Retail Limited has filed this appeal.
Learned Counsel Mr. Dhirendra Singh appeared for appellant.
None appeared for respondent despite sufficient service of notice.
I have heard learned Counsel for the appellant and perused impugned judgment and order as well as records.
Learned Counsel for the appellant has pressed this appeal only to assail order passed by District Consumer Forum whereby District Consumer Forum has ordered appellant/opposite party to deposit Rs.1,00,000/- in Consumer Legal Aid Account Fund.
Perusal of complaint shows that the complainant has filed complaint before District Consumer Forum against opposite party with allegation of excess charging of Rs.1/- than the fixed price of paneer masala 15 gm. Considering the deficiency alleged in complaint against appellant/opposite party the order passed by District Consumer Forum directing appellant/opposite party to deposit Rs.1,00,000/- in Consumer Legal Aid Account Fund appears inconsistent with law.Therefore I am of the view that the appeal should be allowed to this extent only.
In view of above appeal is allowed partly and the order passed by

District Consumer Forum directing appellant/opposite party to deposit Rs.1,00,000/- in Consumer Legal Aid Account Fund is set aside. Remaining part of the impugned judgment and order passed by District Consumer Forum shall remain intact.
Parties shall bear their own costs in this appeal.
It has been informed by learned Counsel for the appellant that the appellant has paid remaining decretal amount to respondent/complainant in pursuance of impugned judgment and order passed by District Consumer Forum.
In view of above submission made by learned Counsel for the appellant it is provided that Rs.25,000/- deposited by appellant in this appeal under Section-15 of the Consumer Protection Act 1986 shall be refunded to appellant alongwith interest accrued on furnishing certificate of District Consumer Forum to the effect that the decretal amount has been recovered to the extent to which it has been upheld by this Commission. If the appellant fails to file such certificate within two months from today the above amount deposited under Section-15 of the Consumer Protection Act 1986 shall be remitted to the District Consumer Forum alongwith interest accrued for disposal in accordance with this judgment.
Let copy of this order be made available to the parties within 15 days positively as per rules.
