1.     Arsh Infrabuild Pvt. Ltd. at its registered address FA-53, First Floor (left side) Back Portion, Thokar No.4, Abdul Fazal Enclave Part-I, Jamia Nagar, New Delhi 110025, through its authorized signatory Mr.Mohd. Mohsin.

2.     Mohd. Mohsin son Mohd. Hasnain, resident of Flat No.11065, Tower-4, Block-A, GH-7, Crossing Republic, Ghaziabad UP 201016.

                                                                        ....Opposite parties.

Complaint under Section 35 of Consumer Protection Act, 2019.

Present:   None for the complainant.

                                                                 

               Today the case is fixed for compromise before Pre National Lok Adalat. None has put in appearance on behalf of complainant.

                A careful perusal of the file reveals that the present complaint has been filed on 03.11.2022 and thereafter notice to the OP was issued for 16.01.2023.

                Thereafter the case was repeatedly adjourned for issuance of notice to OP, subject to filing of correct address but till today the case is going on the same proceedings as the complainant has failed to complete the formalities for getting the service of OP effected. The case pertains to the year 2022 and approximately 2 years have been laposed but the complaint is still at initial stage. It appears that the complainant is not interested to pursue with the present complaint.

                Hence, in view the above facts the present complaint is hereby dismissed. However, complainant is at liberty to file fresh complaint on the same cause of action, after impleading the parties with correct addresses, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
