Taken up through video conferencing. 1. Learned counsel / learned proxy counsel for both sides submit, on respective instructions, that the matter has been settled between the parties. Learned proxy counsel for the appellants also submits, on instructions, that the appellants do not wish to pursue the instant first appeal. Learned proxy counsel further submits, on instructions, that the amount deposited by the appellants with the State Commission in compliance of this Commission’s Order dated 03.05.2019 may be unconditionally and forthwith released to the complainant along with interest if any accrued thereon. 2. No comments of this Commission on the contents and ingredients of the settlement said to have been arrived at. 3. In the wake of the above submissions, this first appeal has become infructuous. 4. The first appeal no. 779 of 2019 is dismissed as infructuous, without the option to file it again before this Commission. 5. The State Commission is directed to unconditionally and forthwith release the amount deposited by the appellants in compliance of this Commission’s Order dated 03.05.2019, along with interest, if any, accrued thereon, to the complainant, as per the due procedure and after the due verification. 6. The Registry is requested to send a copy each of this Order to all the parties in the appeal as well as to their learned counsel within three days.
