Today is fixed for S/R and appearance.

The case was admitted provisionally subject to production of sanctioned plan.

Ld. advocate for the complainant side appears and produces a communication from the concerned municipality which categorically states that there is no sanctioned plan in respect of the suit property.  The commission is of the opinion that no further proceeding in respect of the CC case can be undertaken in respect of a property which is devoid of sanctioned plan and hence illegal in the eyes of law.

In view of the same the instant CC case is dismissed. 

No order is passed as to cost.
